Buying in Mexico Is Different — Here's What You Need to Know

Purchasing property in Baja California Sur as an American or Canadian is completely legal and safe. But it works differently than buying at home. Understanding two key things upfront will save you confusion later.

The Coastal Restricted Zone

Mexican law restricts direct foreign ownership of land within 50km of the coast and 100km of a border. La Paz falls within this zone — which means almost every property your buyers want is affected. This sounds alarming. It isn't. It just means you'll purchase through a fideicomiso.

The Fideicomiso (Bank Trust)

A fideicomiso is a trust held by a Mexican bank on your behalf. You are the beneficiary — you have full rights to use, rent, sell, renovate, and inherit the property. The bank holds the deed in trust. It's the standard legal vehicle for foreign buyers and has been used safely for decades.

La Paz is home now. And I wouldn't change a thing about how we got here.

After retiring from the U.S. Army, I know a thing or two about navigating uncertainty — new cities, new systems, new everything. That turned out to be useful, because buying property in Mexico as a foreigner is genuinely complicated. I know because we lived it. Our first purchase here was a nightmare — the kind that costs you real money and real sleep. We figured our way out of it, learned the process the hard way, and eventually closed on the home we wanted.

That experience is why I do this work the way I do. Every client I work with deserves someone who actually understands the banks, the legal process, and what's at stake — not just someone showing you houses.
